These Terms of Service ("Terms") govern your access to and use of formwhale.com and the formwhale application at app.formwhale.com (collectively, the "Service"), operated by jcraft Studio ("we", "us", or "our"). By using the Service you agree to these Terms.

1. Eligibility

You must be at least 16 years old and able to form a binding contract in your jurisdiction to use the Service. By using the Service, you represent that you meet these requirements.

2. Your Account

• You are responsible for keeping your account credentials secure.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorised access.
• You may not share your account with others or create accounts on behalf of third parties without their consent.

3. Acceptable Use

You agree not to use the Service to:

• Collect data from respondents without a lawful basis or their informed consent
• Distribute spam, phishing forms, or deceptive content
• Collect sensitive personal data (e.g. financial details, passwords) through forms in violation of applicable law
• Violate any applicable law or regulation
• Attempt to gain unauthorised access to any system or data
• Interfere with or disrupt the Service

We reserve the right to suspend or terminate accounts that violate these rules at our sole discretion.

4. Your Content

You retain ownership of all forms and submission data you create through the Service. By using the Service, you grant us a limited licence to store and process your content solely to provide the Service.

You are solely responsible for the content of your forms, including ensuring you have a lawful basis to collect any personal data from respondents, and that your use of that data complies with applicable privacy laws (including GDPR and CCPA where applicable).

5. Subscription and Billing

• Free accounts are provided as-is with no uptime guarantee.
• Paid plans are billed monthly or annually in advance via Stripe.
• You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for unused time, except where required by law.
• We may change pricing with 30 days' written notice. Continued use after the price change takes effect constitutes acceptance.

6. Availability and Support

We aim to provide a reliable service but do not guarantee 100% uptime. We may perform scheduled maintenance with advance notice where possible. The Service is provided "as is" and "as available".

7. Intellectual Property

The formwhale name, logo, and application code are owned by jcraft Studio. You may not copy, modify, or distribute any part of the Service without our written permission. Nothing in these Terms grants you any rights in our intellectual property.

8. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, jcraft Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These Terms are governed by the laws of Hong Kong SAR. Any disputes will be resolved in the courts of Hong Kong.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice in the application. The "Last updated" date above reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
